New Delhi, Sept. 15 -- The Supreme Court on Monday refused to stay the entire Waqf (Amendment) Act, 2025, while staying certain provisions of the law, including the one requiring a person to be a practitioner of Islam for five years to create a Waqf.
The top court bench of Chief Justice of India BR Gavai and Justice AG Masih also stayed the provisions of the law that empowered a collector (DM) to determine whether or not a property declared as Waqf is a government property.
The Supreme Court put a hold on some of the key provisions in the Act, flagging that some of them will lead to 'arbitrary' exercise of power. The bench, however, said it found no case was made out to stay the whole statute, but "some sections need some protection."
