Jodhpur, Aug. 2 -- The Rajasthan high court quashed the Regional Passport Office's decision to deny the re-issuance of a passport to a 61-year-old man from Kota for undertaking Haj pilgrimage.
A bench led by justice Anoop Kumar Dhand ruled that the mere pendency of a criminal case cannot override the fundamental right to personal liberty under Article 21 of the Constitution.
Justice Dhand, while disposing of the writ petition filed by Mohammad Muslim Khan, observed, "Pendency of criminal case under Sections 498-A and 406 IPC cannot be a ground to deny permission to the petitioner to travel abroad for the religious purpose, i.e., Haj, Umra Jiyarat."
