WASHINGTON, July 1 -- Federal Railroad Administration has issued a proposed rule called: Prosecutorial Discretion of Enforcement Attorneys.
The proposed rule was published in the Federal Register on July 1 by Kyle D. Fields, Chief Counsel.
Summary: This proposed rule would clarify that FRA's Office of the Chief Counsel has discretion to decline or dismiss a violation, such as a technical violation where challenged conduct does not raise a practical safety issue.
