New Delhi, March 25 -- The Supreme Court has taken suo motu cognizance of a contentious ruling by the Allahabad High Court, which held that acts such as grabbing a child victim's breasts, breaking the string of her pyjama, and attempting to drag her beneath a culvert do not amount to rape or an attempt to rape. The case will be heard by a Bench, comprising Justices B R Gavai and Augustine George Masih. The case relates to an order passed on March 17, 2025, by the Allahabad High Court, in which the said controversial remarks were passed. Notably, on March 24, a Supreme Court Bench consisting of Justices Bela Trivedi and Prasanna B Varale had declined to entertain a public interest litigation (PIL) challenging the same High Court order.
