Bhubaneswar, Oct. 16 -- The Orissa High Court has held that retired government officials whose pensions were suspended following conviction under the Prevention of Corruption Act are not entitled to restoration of pension until they are acquitted by a higher court.
Justice R.K. Pattanaik, in a recent judgement, observed that "an appeal against an order of conviction and suspension of sentence does not entitle a public servant to restoration of pension."Dismissing a batch of writ petitions filed by convicted government servants, the Court ruled that only when an order of conviction is stayed by an appellate court can a pensioner receive pension and other post-retirement benefits.
