Chhatrapati Sambhajinagar, Aug. 12 -- The Bombay High Court's Aurangabad bench has granted anticipatory bail to Syed Mukhtar Syed Manjoor Ali in a Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act case, with Justice Kishore C. Sant ruling that mere utterance of caste names, without demonstrating caste-based intent to humiliate an SC/ST member, would not automatically constitute an offence under the Prevention of Atrocities Act 1989.
The appellants' advocate, Sayyed Tauseef Yaseen, who successfully argued before the court, said today that the allegations failed to establish the essential elements required to invoke the Act's provisions.
