Bengaluru, Nov. 13 -- The Karnataka High Court on Thursday refused to quash the POCSO case registered against former Chief Minister BS Yediyurappa, while allowing him the liberty to seek exemption from personal appearance during the trial, unless his presence is deemed essential.
Justice MI Arun upheld the Special Court's order dated February 28, which had taken cognizance of the alleged offence and issued summons to Yediyurappa. However, the judge clarified that the trial court should not insist on his appearance except when necessary, and must consider any exemption applications filed on his behalf.
The court further observed that Yediyurappa, also a former MP, is free to move an application for discharge before the trial court.
