Shimla, Nov. 17 -- Himachal Pradesh High Court has declined to entertain Zydus Wellness Products Ltd's plea seeking interim protection over its Glucon-D and Glucon-C trademarks, refusing to restrain Leeford Healthcare Ltd from selling its Rock-On Glucose-D and Glucose-C products.
The court held that Zydus failed to demonstrate a prima facie case of infringement or deceptive similarity, and that the expressions "Glucose-D" and "Glucose-C" are generic descriptors widely used in the trade.
