Shimla, Oct. 28 -- The Himachal Pradesh High Court has issued an important ruling in a case involving discrepancies in pay fixation.
The court clarified that a junior employee's salary cannot exceed that of his or her immediate superior, but if the mistake is due to an administrative error, the overpayment will not be recovered, provided the error is not on the employee's part.
During the hearing, a division bench of Justice Jyotsna Rewal Dua found that the petitioner was receiving an overpayment due to an incorrect option, which was contrary to paragraph 4(2)(a) of the February 10, 2022, instructions.
