Shimla, Aug. 11 -- Himachal Pradesh High Court has directed the State government to issue an appointment letter to Yog Raj on compassionate grounds, ruling that the mere pendency of an FIR for petty offences cannot be a reason to deny employment.

Justice Sandeep Sharma, delivering the verdict in CWP( No. 6233) of 2022 recently observed that until charges are framed and guilt is proven in a competent court, an accused is deemed innocent.

The court held that the pending FIR, registered under Sections 323 and 325 IPC in 2019 over a village altercation, did not involve moral turpitude serious enough to withhold the petitioner's appointment as Junior Office Assistant (IT).
