Shimla, Nov. 28 -- Himachal Pradesh High Court has rejected UCO Bank's attempt to take action under the SARFAESI Act against a woman who had no connection with the loan, the borrower, or the mortgage.
The Court held that the Bank could not proceed against someone who was simply a later purchaser of the property and had nothing to do with the original transaction.
Justice Ajay Mohan Goel observed that the main issues in the case involved allegations of fraud and the validity of documents, matters that fall within the jurisdiction of a civil court, not under the SARFAESI Act.
