Shimla, July 24 -- In a significant ruling, the Himachal Pradesh High Court has set aside the state government's decision to deduct pension from the salary of Justice (Retired) V.K. Sharma during his tenure as Chairman of the Himachal Pradesh Administrative Tribunal (HPAT).
The court ruled that such a deduction was illegal and amounted to varying the service conditions to his disadvantage after his appointment.
The judgment, delivered by Justice Sandeep Sharma, held that the petitioner's salary was fixed at Rs 80,000 (fixed) per month by the President of India, and any deduction on account of pension from his previous service as a High Court judge was impermissible.
