Shimla, Dec. 31 -- Himachal Pradesh High court has directed the State government to take a judicious and reasoned decision on restrictive eligibility conditions in sanitation tenders for public health institutions, cautioning against cartelisation, narrow competition and artificial barriers to entry for experienced firms.

A Division Bench comprising Chief Justice G.S. Sandhawalia and Justice Jiya Lal Bhardwaj was hearing a writ petition filed by M/s Tania International Company challenging Clause F(c) of the Notices Inviting Tenders (NITs) issued by the Health & Family Welfare Department. The impugned clause restricts eligibility only to firms having prior experience of hospital sanitation services within Himachal Pradesh.
