Shimla, Aug. 26 -- In a landmark judgment that could set a precedent across the country, the Himachal Pradesh High Court has directed the National Highways Authority of India (NHAI) to compensate the National Law University (NLU), Shimla, after its hostel building declared unsafe during highway widening work.
The division bench of Chief Justice Gurmeet Singh Sandhawalia and Justice Satyen Vaidya ruled that the scope of compensation must not be restricted to the Right of Way (ROW).
" If structures and land beyond the ROW are impacted by highway construction or related landslides, those affected are equally entitled to relief." the order said.
