Mumbai, May 4 -- The Bombay High Court has allowed Grasim Industries and UltraTech Cement to present additional documents on record in their trademark dispute case with a company called Saboo Tor Pvt Ltd over the use of the word "Birla", recognising that they are relevant to decide the case, but they could not be produced earlier despite due diligence.
Earlier, the court had refused to restrain Saboo Tor from using the trademark like 'Birla TMT', during the pendency of the trademark dispute case.
While refusing interim relief, a single judge had found that Grasim Industries and UltraTech Cement had not supported their claims with documents. The court had also observed earlier, that "there is not a single document on record" to show prior ...
