New Delhi, Sept. 6 -- A Special CBI Court at Rouse Avenue on Saturday discharged Delhi Police Head Constable Girish Kumar in a bribery case, ruling that the prosecution sanction had not been issued by a competent authority.
The order came while hearing an application moved by Kumar, represented by Advocate Sandeep Sharma, who argued that the proceedings were vitiated due to the absence of a valid sanction under Section 19 of the Prevention of Corruption Act.
Special Judge (PC Act) Jagdish Kumar, after considering arguments from both sides, held that even though cognizance of the case had already been taken, the legitimacy of the sanction could be challenged at any stage of the trial.
