New Delhi/Shimla, Feb. 5 -- In a significant ruling reaffirming the constitutional guarantee of citizenship by birth, Delhi High court has declared a Tibetan-origin woman born in Dharamshala in 1966 as an Indian citizen and directed authorities to issue her an Indian passport.
Single bench of Justice Sachin Datta in a landmark verdict passed on Febuary 2, allowed the writ petition filed by Yangchen Drakmargyapon and held that her case falls within the ambit of Section 3(1)(a) of the Citizenship Act, 1955, which grants Indian citizenship by birth to every person born in India between January 26, 1950 and July 1, 1987.
The court ordered the union of India to process and issue her an Indian passport in accordance with the law.
