Prayagraj, April 2 -- In an important ruling, the Allahabad High Court stated that under Mohammedan law, divorce is effective from the date the husband pronounces divorce.
The High Court stated that a subsequent court order confirming it is merely promulgatory in nature. The petition was filed by petitioner Humaira Riaz.
The order was delivered by a single bench of Justice Madan Pal Singh on Thursday.
The High Court also stated in its decision that such a court order does not create a new divorce from the date of the decision; rather, it is considered to be connected to the original date of the pronouncement of divorce.
