
New Delhi, April 17 -- The Supreme Court continues hearing a batch of pleas challenging the constitutional validity of the Waqf (Amendment) Act 2025, today. This comes a day after the apex court heard 10 petitions on the Waqf Act, with the possibility of a stay on some of the new provisions in the Bill passed by the Parliament. The bench hearing Waqf pleas includes Chief Justice of India Sanjeev Khanna, and Justices Sanjay Kumar and K V Viswanathan.
What happened in the SC hearing on Wednesday? Arguing on behalf of the petitioners on Wednesday, senior advocate Kapil Sibal said that the amendments in the Waqf Act are against Article 26 of the Constitution of India. The top court, during the course of the hearing, proposed to stay certain key provisions of the Act including the power to de-notify properties declared waqf by courts and inclusion of non-Muslims in central Waqf councils and boards.
10 petitions filed against Waqf Act: A total of 10 pleas were listed in the Supreme Court challenging the constitutional validity of the Waqf Act. The pleas were filed by AIMIM chief Asaduddin Owaisi, AAP leader Amanatullah Khan, Association for the Protection of Civil Rights, Arshad Madani, Samastha Kerala Jamiathul Ulema, Anjum Kadari, Taiyyab Khan Salmani, Mohammad Shafi, Mohammed Fazlurrahim and RJD leader Manoj Kumar Jha. Fresh pleas filed by TMC MP Mahua Moitra and Samajwadi Party leader Zia-ur-Rahman Barq were also listed.
