PATNA HIGH COURT ISSUES ORDER ON MAQSOOD ALI V/S THE STATE OF BIHAR

PATNA, India, June 11 -- Patna High Court issued the following order on May 13:

1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned APP for the State, at the outset, after perusing the case diary submits that the notice under Section 41(1)(b) of the Cr.P.C. has already been issued to the petitioner.

3. The learned counsel appearing on behalf of the petitioner submits that petitioner has received the notice under Section 41(1)(b) of the Cr.P.C and thus seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises.

4. Permission is accorded.

5. Accordingly, the instant anticipatory bail application is dismissed as withdrawn with the liberty aforesaid.
