PATNA, India, May 29 -- Patna High Court issued the following order on May 1:
Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.
3. As per F.I.R., 4 liters of country-made (chulai) liquor has been recovered from an open place and this petitioner is alleged to have fled away from the spot.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioner and has been implicated in this case only on suspicion. Petitioner has got one criminal antecedent of similar nature, in which, he is on bail.
