Heard Mr. Kunwar Narayan Jamuar, learned counsel appearing for the appellant as well as Mr. Mukeshwar Dayal, learned Additional Public Prosecutor for the State.
2. This appeal has been preferred by the appellant challenging the judgment of conviction and order of sentence dated 23rd November, 2005 passed by Sri. Abdur Rahman, Additional Sessions Judge III, Gaya in Sessions Trial No. 109/2003 and 539 of 2003 arising out of Kotwali P.S. Case No. 109 of 2002, whereby and whereunder appellant has been convicted for the offence punishable under Section 304(B)/34 of the Indian Penal Code. He has been sentenced to undergo rigorous imprisonment for seven years.
