Heard learned counsel for the petitioner and learned APP for the State.
2. By way of this application, the petitioner has challenged the order dated 30.08.2005 passed by the learned Additional Chief Judicial Magistrate, Barh, in connection with Bakhtiyarpur P.S. Case No.45 of 2005, whereby the learned Magistrate has taken cognizance against the petitioner under Section 171(H) of the Indian Penal Code and under section 3 of the Bihar Prevention of Defacement of Property Act.
