JABALPUR, India, Jan. 15 -- Madhya Pradesh High Court issued the following judgment/order on Dec. 16:
1. Learned counsel appearing for the respondents raises a preliminary objection with regard to maintainability of the writ petition. He submits that since petitioner is impugning an order rejecting an application under Section 34 of Arbitration and Conciliation Act, 1996, remedy would have been by way of an appeal under the said Act.
2. Faced with the objection, learned counsel for the petitioner seeks leave to withdraw the petition reserving the right of the petitioner to approach the jurisdictional appellate Court.
3. Petition is accordingly dismissed as withdrawn. Liberty as prayed for.
