MADHYA PRADESH HIGH COURT ISSUES ORDER ON RAJESH SAHU AND OTHERS V/S NATIONAL HIGHWAY AUTHORITY OF INDIA AND OTHERS

JABALPUR, India, Aug. 6 -- Madhya Pradesh High Court issued the following judgment/order on July 10:

1. Petitioners impugn an award dated 02.06.2025 (Annexure P-8) passed by the respondent No.3 in Case No.055/B-121/25-26 under the National Highways Act, 1956 (hereinafter referred to as "the Act").

2. Since petitioners are aggrieved by the award, petitioners have the alternative remedy under Section 3G(6) of the Act, which stipulates that the provisions of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as "the Act of 1996") would be applicable to any award passed.

3. In view thereof, the petition is disposed of relegating the petitioners to avail of the alternative remedy, as provided under the Act of 1996.
