1. Heard Mr. S. D. Purkayastha, the learned counsel appearing on behalf of the appellant. Ms. R. Rongmei, the learned counsel appears on behalf of the respondents.
2. This is an Appeal filed under Section 100 of the Code of Civil Procedure, 1908 (for short, 'the Code') challenging the judgment and decree dated 05.09.2024 passed in Title Appeal No.31/2017, whereby the Appeal so filed by the respondent No.1 herein who was the defendant No.3 in the suit was allowed thereby setting aside the judgment and decree dated 26.09.2017 passed by the learned Court of the Munsiff, Lakhipur, Cachar (for short, 'the learned Trial Court') in Title Suit No.125/2012.
