Heard Mr. M. I. Hussain, learned counsel for the petitioners. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State respondent.
It is submitted by Mr. Baishya, learned Additional Public Prosecutor, that the updated Case Diary along with the Medical Report was called for; however, the same has not yet been received to date.
In this regard, Mr. Hussain, learned counsel for the petitioners, submits that petitioner Nos. 1 and 2 have been arrested during the pendency of the case, and hence, the petition in respect said petitioners has become infructuous.
