GAUHATI HIGH COURT ISSUES ORDER FOR PAUL EMPORIUM V/S THE UNION OF INDIA AND ORS

GUWAHATI, India, May 23 -- Gauhati High Court issued the following order on April 23:

Heard Mr. D. Saraf, learned counsel for the petitioner. Also heard Mr. S. C. Keyal, learned Standing Counsel for the GST.

The petitioner has challenged two orders i.e. order-in-original dated 15.11.2022 issued by the respondent No. 3 and order-in-original dated 20.12.2023 issued by the respondent No. 4.

According to the petitioner, both the aforesaid orders-in-original is relatable to the same period and therefore, such orders-in-original are not sustainable in law inasmuch as such orders-in-original is passed without jurisdiction.

Mr. Keyal, learned Standing Counsel for the GST submits that he need to obtain instruction.
