SVU to file SLP in SC challenging HC order in favour of BAS officer
PATNA, Dec. 12 -- The special vigilance unit (SVU) of Bihar government will file a Special Leave Petition (SLP) in the Supreme Court, challenging the Patna High Court order quashing an FIR against Bihar Administrative Service (BAS) officer Sweta Mishra in connection with a DA case, official familiar with the matter said on Thursday.
Mishra, when posted as Public Grievance Redressal Officer (Katihar) has amassed huge movable and immovable assets from 2011-2012 to the extent of approximately Rs.80.11 lakh which are alleged to be disproportionate to her known and legitimate sources of income. It is alleged that she is a 48th-52nd Batch officer of the BAS, who joined service in 2011 and has a total service length of 14 years, during which she earned approximately Rs.95 lakh as salary. Her expenditure during the said period is computed at Rs.38.79 lakh leaving a likely saving of about Rs.56.20 lakh. However, she is found to be in possession of movable and immovable assets worth Rs.1.36 crore either in her own name or in the names of her family members and others, alleged to have been acquired illicitly by corrupt means, thereby reflecting disproportionate assets of Rs.80.11 lakh accumulated between 2011 till the date of inquiry. On the basis of the credible information received on his self statement, the SVU registered the FIR on June 3, 2025 against her.
Sweta Mishra, a native of Prayagraj in UP filed a petition before the HC on June 20, 2025 seeking quashing of the FIR and setting aside the FIR relating to SVU.
On November 11, the bench of Justice Purnendu Singh, quashed and set aside the FIR. "Thus, the state cannot prosecute the petitioner (Sweta Mishra) without reasonable prospect of conviction in view of the discussion(s)/observation(s) made hereinabove. The Prosecution of the accused on the basis of the investigation, in such circumstances, cannot be allowed. Accordingly, the FIR bearing SVU is hereby quashed and set aside. The present quashing application stands disposed of," the order says....
