PATNA, Oct. 18 -- The Patna High Court on Monday ordered the state government to file a counter affidavit in response to the petition filed by RJD MLA from Danapur Ritlal Yadav, seeking four-week release for campaigning in his constituency during the current assembly elections. Ritlal, also known as Ritlal Rai, imprisoned in Bhagalpur central jail, has filed a writ petition before the HC requesting his temporary release from jail for election campaigning. Petitioner's senior advocate Yogesh Chandra Verma argued in the court that this was a special circumstance that necessitated the petitioner's release from jail. He cited several court decisions, including the case of former Delhi chief minister Arvind Kejriwal. Verma stated that the petitioner could also be granted bail for a few days through the writ petition. Meanwhile, advocate general PK Shahi during hearing stated that the present writ petition was not maintainable and for the relief claimed in the petition, the petitioner should have approached the trial court seeking provisional/regular bail. The AG further submitted that the criminal antecedents of the petitioner had not been disclosed and the authorities/rulings relied on by the learned senior counsel for the petitioner did not support the case of the petitioner. The court of Justice Arun Kumar Jha, found that the criminal antecedents of the petitioner had been mentioned in general and vague terms without providing any specific details. There are over 36 FIRs registered against Ritlal with Khagaul, Danapur, Bihta, SK Puri, Beur, Maner, Rupaspur and Bakhtiyarpur GRP as well as Enforcement Case Information Report (ECIR). "The state/respondents are directed to file their counter affidavit on or before October 30. At the request of senior counsel for the petitioner, list this case on October 30," ordered Justice Arun Kumar Jha.
