Man gets 3 yrs in jail for sexual assault on minor
DARBHANGA, May 6 -- The special POCSO court in Darbhanga, presided over by judge Protima Parihar, on Monday sentenced Shankar Paswan from a village under Keoti police station area, to three years of imprisonment along with a fine of Rs.25,000 for sexually assaulting a minor and using criminal force to outrage her modesty.
The court directed that the fine amount be paid to the victim as compensation. Additionally, the judge ordered that the victim be provided Rs.3 lakh from the Bihar Victim Compensation Scheme through the District Legal Services Authority (DLSA), said Santosh Kumar Singh, the advocate representing the complainant.
The incident had occurred on August 8, 2020, and was registered as FIR No. 43/2020 based on the minor's statement, naming Shankar Paswan, Ramashish Paswan and Dilip Paswan as accused. The investigating officer (IO) found the charges against Shankar Paswan to be valid and submitted chargesheet No. 62/20 on November 11, 2020.
The court took cognizance under IPCSsection 376 and POCSO sections 4/6 on November 25, 2020, and framed charges on February 24, 2021.
Special public prosecutor Vijay Kumar Parajit informed that eight witnesses were examined by the prosecution, and after hearing arguments from both sides, the court delivered its judgment.
The court sentenced the convict to three years of imprisonment and a fine of Rs.5,000 under Section 12 of the POCSO Act, two years and Rs.5,000 under IPC Section 452, three years and Rs.5,000 under IPC Section 506, two years and Rs.5,000 under IPC Section 354, and two years and Rs.5,000 under IPC Section 354(A).
