Jharkhand ACB nabs noted bizman in forest land fraud
Ranchi, Sept. 27 -- The Hazaribagh unit of the state Anti-Corruption Bureau (ACB) on Friday produced automobile showroom owner Vinay Kumar Singh before the ACB court following his arrest in a forest land fraud that took place during the tenure of suspended IAS officer Vinay Kumar Choubey, currently under suspension and in jail for two corruption cases, as deputy commissioner of the district, officials said.
An ACB official aware of the development said, "He was produced in the court in the morning, and from the court, Singh was sent to jail. Singh was produced before the court in the morning, and from the court, he was sent to the Lok Nayak Jaiprakash Narayan Central Jail in 14-day judicial custody."
A press release issued by the ACB on Thursday evening stated that Singh was arrested under section 120B of the Indian Penal Code (IPC) read with sections 420, 467, 468, 471, and section 13(2) read with section 13(1)(d) of the Prevention of Corruption Act, 1988, registered against him at the ACB, Hazaribagh police station.
According to the FIR, Singh was the beneficial purchaser of the forest land sold in violation of the Indian Forest Act, 1927, the Forest Conservation Act, 1980, and the Supreme Court order.
The FIR stated that a conspiracy was hatched in the land dealing as the Jamabandi of five plots of similar nature was cancelled by the Hazaribagh deputy commissioner in 2013. And the same was also confirmed by the land and revenue department and the forest department.
"Illegal Jamabandi of five plots was cancelled by the deputy commissioner's office, Hazaribagh, in 2013. The cancelled Jamabandi was confirmed by the revenue and land reforms department, Jharkhand Government, in 2013 itself. In this regard, the office of the forest division officer, Hazaribagh eastern forest division, in its letter no. 2612 dated 05.12.2012, states that 'Any non-forestry work and encroachment on notified forest land is a violation of the Indian Forest Act, 1927, and the Forest Conservation Act, 1980. As per the order dated 12.12.1996 passed by the Supreme Court in Writ No. 202/95, T. Godavarman vs. Union of India, use of any land registered as forest-scrub land for non-forestry purposes without prior permission of the Government of India would be a violation of the Forest Conservation Act, 1980'.
"Therefore, the cancellation of the Jamabandi by the circle officer, Sadar Hazaribagh, is justified on the ground that the abovementioned land was non-majurwa khas forest-scrub land. Despite this, the same type of Gair-majurwa (special forest land) was mortgaged on a parallel basis through criminal conspiracy with officials, collectively obtaining unethical benefits, thus committing a cognizable offence, in which the accused in the FIR, Vinay Kumar Singh, is the beneficial purchaser. Therefore, the accused has been arrested on these charges," the press release read.
A high court lawyer close to the matter said the fresh case in the Hazaribagh land scam may put Choubey in further trouble.
"Choubey, who was arrested by the ACB on May 20 in a liquor scam case, is already under the scanner of the ACB in a land scam that took place during his tenure as Hazaribagh DC. The ACB has already booked Choubey in the land scam case. Though the ACB court has granted bail to Choubey in the liquor scam case, he has yet to get bail in the land scam case. Coincidentally, Singh is a co-accused in a liquor scam case involving Choubey, but was on bail in that court. After his arrest in the land scam case, he has come closer to Choubey," he said....
