PATNA, May 5 -- The Patna High Court has directed the Bihar Public Service Commission (BPSC) to ensure a compensation of Rs.20.20-lakh to a petitioner, who challenged denial of his appointment and selection of a candidate on the basis of an invalid disability certificate, from the pocket of those responsible, besides initiating disciplinary action. The court also directed respondents, BPSC and the Bihar government, to accord appointment to the petitioner Durgesh Kumar, on the post of lecturer in Vocal Music (Arts and Craft) within a period of eight weeks from the date of the communication of this order with notional benefits from 21.07.2020, the date on which the BPSC sent recommendation to the department concerned. "The BPSC Chairman must exercise his constitutional duty to investigate into the matter in respect of the functioning of the members and the employees and proceed to take disciplinary action against them, who are liable to compensate the petitioner from their own pocket to protect the image of the Commission in public interest," said the bench of Justice Purnendu Singh in its oral order, which was uploaded on Saturday. The court said that the petitioner was liable for payment of compensation of Rs.20,00,000 and cost of Rs.20,000 to be paid by the BPSC on account of mental agony and harassment caused to him in view of "proved malicious conduct" in the recruitment process in publishing the result of a person, who was not having valid disability certificate till the last date of submission of the application form. The issue involved selection of Kamlendra Prasad, after the expiry of validity of his disability certificate by petitioner Durgesh Kumar on the ground that Rule 42 of the Bihar Persons with Disabilities Equal Opportunities, Protection of Rights and Full Participation Rules, 2004 mandates that validity of the certificate will remain valid only for three years. The temporary certificate, which was produced and accepted for selection had been issued in 2008, I.e. after the end of validity period of three years, while the advertisement itself was dated April 3, 2016. However, later the selected candidate produced permanent disability certificate, though, after the process of selection had completed....
