JODHPUR, May 31 -- In a scathing order aimed at systemic reform, the Rajasthan high court on Wednesday directed the chief secretary and the principal secretary of the revenue department to review the functioning of the Board of Revenue and take steps to improve its appointment process. The court expressed serious concern over the board's conduct in routinely passing orders that cause "harassment of the litigants" and place an "unnecessary burden on this court." Justice Dinesh Mehta observed: "Have a review of the functioning of the board and take necessary steps to improve the appointment process, while keeping a vigil over their performance. Because, such type of orders come before this court quite often, which not only amounts to harassment of the litigants but also increases unnecessary burden on this court." The order came while hearing a writ petition filed by Omprakash and Dheeraj Chandak of Jodhpur, who had challenged the board of revenue's interference in a routine adjournment granted by a trial court. The sub-divisional officer at Luni had on April 15, 2024 granted a seven-day extension to a party despite rejecting a request for a 15-day adjournment. Though this order had already been acted upon and trial proceedings had moved forward, the board of revenue entertained a revision petition and stayed the matter, calling it a "substantial question of law".. Justice Mehta termed the board's intervention "absolutely contrary to settled practice" and remarked: "This court is surprised rather shocked to see such an order passed by the Board of Revenue... one fails to comprehend how the Board of Revenue can interfere in such an innocuous order that too holding that the matter involves substantial question of law."...
