Conviction and jail sentence of BJP mla upheld by special appellate court
DARBHANGA, May 24 -- The court of district and additional sessions judge-III, also doubling as special appellate judge of the MP/MLA court, Suman Kumar Diwakar, on Friday upheld the three-month imprisonment awarded to BJP MLA Mishri Lal Yadav and his aide Suresh Yadav by the trial court.
The appellate judge rejected their appeal and directed that both be remanded to the divisional jail with immediate effect.
The special judge of the MP/MLA court had ordered their judicial custody a day earlier, in connection with a pending criminal appeal. Following the court's direction, both were taken into custody and sent to Darbhanga Jail.
According to special public prosecutor (PP) Renu Jha, the case was originally lodged by Umesh Mishra of Samailla village (FIR no. 4/19) at Raiyam police station on January 30, 2019, a day after the alleged incident, accusing MLA Mishri Lal Yadav, Suresh Yadav of Pachadhi village, and 20-25 others of assault, verbal abuse, and causing him head injuries.
The trial was conducted in the MP/MLA court presided over by judge Karunanidhi Prasad Arya, who, on February 21, 2025, convicted MLA Yadav and Suresh Yadav under IPC section 323 and sentenced them to three months' imprisonment along with a fine of Rs. 500 each.
"While both convicts had filed an appeal seeking relief from the sentence, the complainant sought harsher punishment and the addition of further charges," the special PP added....
