BJP MLA, aide sent to judicial custody in Darbhanga
DARBHANGA, May 23 -- In a significant development, special judge of MP/MLA court and additional district and sessions judge Suman Kumar Diwakar on Thursday ordered the judicial custody of BJP MLA Mishri Lal Yadav and his aide Suresh Yadav in connection with a pending criminal appeal. Both were taken into custody and forwarded to Darbhanga Jail.
The appeal stems from a 2019 case registered at Raiyam police station (FIR no. 04/19), in which Mishri Lal Yadav, the sitting MLA from Alinagar constituency, and Suresh Yadav, a resident of Gosai Tol Pachadhi village, were accused of assault.
On February 21, 2025, the then presiding judge of the MP/MLA court, Karunanidhi Prasad Arya, convicted both under section 323 of the Indian Penal Code (IPC) and sentenced them to three months of imprisonment along with a fine of Rs 500. The conviction was challenged through criminal appeal no. 03/25.
During Thursday's hearing, the court, citing precautionary grounds, remanded both the appellants to judicial custody.
Special public prosecutor Renu Jha stated, "Following Thursday's hearing, the court has sent both individuals to judicial custody. The final judgment on the appeal will be pronounced on Friday."
The original complaint was filed by Umesh Mishra of Samaila village, who alleged that on the morning of January 29, 2019, he was attacked during a morning walk near Kadam Chowk in Gosai Tol by Mishri Lal Yadav, Suresh Yadav, and 20-25 others armed with weapons. According to the FIR, dated January 30, 2019, the accused MLA struck him on the head with a pharsa (a sharp weapon), while Suresh Yadav allegedly beat him with rods and sticks and robbed him of Rs 2,300. The injured complainant was initially treated at Keoti PHC and later referred to DMCH for further treatment.
68-year-old Mishri Lal Yadav was elected MLA from Alinagar Assembly seat in Darbhanga in 2020 on a Vikassheel Insaan Party (VIP) ticket. In 2022, he joined the BJP along with other VIP MLAs. Earlier, he has also been a member of the Bihar Legislative Council from 2003 to 2009....
