PATNA, July 25 -- The membership of BJP MLA from Alinagar in Darbhanga district, Mishri Lal Yadav was reinstated with retrospective effect in the light of a Patna High Court order, which set aside the special court's verdict. "In the light of the HC order...Yadav's membership is reinstated with retrospective effect," said the notification issued by Vidhan Sabha secretary-in-charge Khyati Singh. According to a notification on Wednesday late evening, Yadav, MLA from Alinagar assembly seat, who was earlier disqualified as a member of Bihar assembly after being sentenced to two years of rigorous imprisonment along with a fine of Rs.1 lakh by the special MP/MLA court in Darbhanga in a 2019 case of criminal intimidation is 'now reinstated". "The decision has been taken following the Patna HC order dated July 18, in which the judgments, passed by the trial court as well as the appellate court and criminal appeal number, are set aside", said the notification. The case originated from an FIR filed on January 30, 2019 by Umesh Mishra of Samaila village, alleging assault by the accused. After the investigation, the police filed a charge sheet and the court took cognisance of the case on April 17, 2020. On February 21, 2024 the lower court convicted Yadav under Section 323 of the IPC (voluntarily causing hurt) and sentenced him to three months of imprisonment and a fine of Rs.500. Dissatisfied with the ruling, the MLA also sought a pardon and appeared before the MP/MLA court on May 22, hoping to secure relief, but was rejected by the special court. Mishri Lal Yadav is the first MLA of BJP and third MLA of 17th Bihar assembly to be disqualified this year. In March, the Bihar Legislative Council membership of RJD leader Sunil Kumar Singh was also reinstated in compliance with the February 25 judgement of the Supreme Court.
