New Delhi, July 22 -- The Supreme Court on Monday told the Central Bureau of Investigation (CBI) that there is sufficient material to initiate a probe into the alleged wrongdoings by non-banking financial company (NBFC) Indiabulls Housing Finance Limited (IHFL) in advancing loans to corporate entities. The court was considering a petition filed by non-government organisation (NGO) Citizens Whistleblower Forum which had approached the court seeking probe against IHFL, now known as Sammaan Capital Limited, after the Delhi high court had refused to entertain the same. On May 14, the court had issued notice to the CBI after going through responses filed by the Enforcement Directorate (ED) and Securities Exchange Board of India (Sebi) endorsing some of the allegations levelled in the petition against IHFL. A bench of justices Surya Kant and Joymalya Bagchi said, "What more information do you require? You are party to these proceedings where all this is on judicial record. What more do you want?" The matter will be heard next on July 30. The court was responding to a submission made by additional solicitor general (ASG) SV Raju appearing for both the ED and CBI. He said, "While ED requires a predicate offence, there is no such thing with CBI. It requires only information to register an FIR." The petitioner's lawyer Prashant Bhushan informed the court that earlier the ED had submitted a status report to court detailing IHFL's alleged wrongdoings in two cases the agency probed. Bhushan told the court that the CBI was made a party on May 14 when the case was last heard, to enable investigation in the matter as ED requires a predicate offence to proceed with its probe. The bench told Raju, "In a case where ED has to take up the matter suo motu, you need a predicate offence. But where there is judicial intervention, do you still need a case to be filed?" ASG Raju said, "The CBI is not shy of investigating," as he requested time to take instructions. The court posted the matter for hearing on July 30....
