MUMBAI, June 19 -- HDFC Bank MD and CEO Sashidhar Jagdishan, 60, has approached the Bombay High Court seeking to quash a First Information Report (FIR) filed against him in a case involving the Lilavati Kirtilal Mehta Medical Trust, which manages the prominent Lilavati Hospital in Bandra West. The FIR, registered on May 31 following a Bandra magistrate's order, stems from a complaint by trustee Prashant Mehta, who alleged that Jagdishan accepted Rs.2.05 crore in cash from former trustees, led by Chetan Mehta, to help them retain illegal control over the trust and to harass his late father Kishor Mehta, whose company was embroiled in a loan default dispute with HDFC Bank. Prashant claims the harassment caused severe emotional distress, leading to Kishor Mehta's death on May 20, 2024. The complaint cites a photocopy of a cash register and diary entries as evidence of the alleged payments made between March 2022 and June 2023. The FIR, ordered by a Bandra magistrate on May 29, invoked serious charges under sections 406, 409 (criminal breach of trust), and 420 (cheating) of the Indian Penal Code, and Section 175(3) of the Bhartiya Nagrik Suraksha Sanhita (BNSS). It alleges that diary entries and cash register photocopies unearthed by Prashant Mehta show systematic misuse of trust funds, including the Rs.2.05 crore allegedly paid to Jagdishan. Jagdishan, represented by senior advocate Amit Desai, has denied all allegations, calling the FIR baseless, vindictive and retaliatory. He argued that the complaint is linked to HDFC Bank's recovery proceedings against Splendour Gems Ltd, owned by the Mehta family, which defaulted on loans worth Rs.65.22 crore. The petition said the magistrate's order was flawed and contradictory, as it directed an investigation despite admitting there was no corroborative evidence beyond the diary entries. Jagdishan has sought a stay on any coercive action, including filing of a chargesheet, pending the hearing. The case was listed before multiple benches, but Justices Rajesh Patil and Sarang Kotwal recused themselves from hearing it. The matter will now be reassigned. Separately, Bandra police have registered another FIR against Chetan Mehta and others for alleged embezzlement of Rs.2.25 crore of trust funds....
