New Delhi, May 23 -- The Central Bureau of Investigation said on Thursday it has filed a charge sheet against former Jammu and Kashmir governor Satya Pal Malik and seven others in its case related to alleged corruption in the award of a contract worth Rs.2,200 crore of civil works of Kiru Hydro Electric Power Project (HEP) to a private company in the Union territory. Malik was effectively the whistle-blower who pointed to corruption in this contract. He was raided by the agency in February last year. A CBI official said on Thursday that "the charge sheet has been filed after completion of probe and gathering prosecutable evidence against all the accused persons including Malik". The federal anti-corruption probe agency had launched a probe in April 2022 in the contract - a 624-megawatt run-of-river project over the Chenab river in Kishtwar district. The governor of Jammu and Kashmir from August 23, 2018, to October 30, 2019, Malik had alleged that he was offered a Rs.300-crore bribe for clearing two files, including the one pertaining to the project. Malik, a member of BJP, has, in recent years, turned a critic of the BJP-led NDA government in New Delhi, and Prime Minister Narendra Modi over the handling of the farm protest in 2020-21. Other than Malik, those named in charge sheet include his two key aides: Virender Rana and Kanwar Singh Rana; then Chenab Valley Power Projects Pvt Ltd (CVPPPL) managing director MS Babu, its directors Arun Kumar Mishra and MK Mittal, managing director of construction firm Patel Engineering Ltd Rupen Patel and private person Kanwaljeet Singh Duggal, officer said. Moments after the news about CBI charge sheet broke, Malik said in a post on X that he was admitted in a hospital and was not in a condition to talk to anyone. The former governor said "he was getting calls from many well-wishers which he was unable to take". The federal agency registered a case on April 20, 2022, at the request of the J&K government. It was alleged that there was corruption in awarding the civil work contract related to the Kiru Hydro Electric Power Project (HEP) worth Rs.2,200 crore. In its first FIR, CBI had alleged, "Though a decision was taken in the 47th board meeting of CVPPPL (Chenab Valley Power Projects (P) Ltd) for re-tender through e-tendering with a reverse auction after the cancellation of the ongoing tendering process, the same was not implemented (according to the decision taken in the 48th board meeting) and the tender was finally awarded to Patel Engineering Limited". CBI said in July 2022 that "in award of civil works package of Kiru Project, guidelines regarding e-tendering were not followed and though a decision was taken in the board meeting of CVPPPL (Chenab Valley Power Projects (P) Ltd) for re-tender through e-tendering with reverse auction, after cancellation of tendering process, this wasn't implemented (as per decision in next board meeting) and tender was awarded to said private company"....
