Won't disturb possession of shop owner: Govt to HC
PRAYAGRAJ, May 24 -- The state government has given an undertaking before the Allahabad high court that it would not disturb the possession of the petitioner-a shop owner-nor demolish his constructions at Dalmandi area of Varanasi unless title over the same is acquired through voluntary transfer or by compulsory acquisition or any other mode recognised under law.
Taking this submission of the state on record, a division bench comprising Justice Manoj Kumar Gupta and Justice Anish Kumar Gupta in its decision dated May 20 disposed of the writ petition filed by one Shehnaz Parveen, saying, "Keeping in mind the aforesaid stand, the writ petition stands disposed of in terms of the same."
Earlier, on May 9, the court had directed the parties to maintain status quo of the houses coming under the purview of Dalmandi road widening in Varanasi. Along with this, a reply was sought from the state government and district administration in the matter within a week.
The counsel for the petitioners contended that Varanasi district administration is preparing a report of compensation for all the houses. "The Dalmandi project is worth more than Rs 100 crore, so cabinet approval is necessary. DM's report will be sent to the state government," the counsel said.
To ease the way to Kashi Vishwanath temple, the state government has decided to widen the Dalmandi road connecting the new road to Chowk by 17 metres (56 feet). Around 189 houses are coming under the purview of the widening.
According to the records, most of the houses coming under the purview of the widening are built on inhabited land. In protest against the widening of the said road, half-a-dozen house owners/shopkeepers of Dalmandi have filed a petition saying that the entire market will disappear due to the width of the road....
