Teacher's 'punitive' transfer order junked
JODHPUR, June 2 -- The Rajasthan high court on Friday quashed the transfer of a teacher who was assigned to teach English despite being qualified only for social science.
The court observed that compelling a teacher to teach a subject beyond her academic qualifications could not only have adverse consequences for the teacher but would also deprive students of their right to quality education under Article 21-A of the Constitution.
A division bench made these remarks while allowing a special appeal filed by Gauri, a teacher from Sri Ganganagar, who challenged the orders transferring her to teach English at a senior secondary school, even though her graduation subjects were history and economics.
