PRAYAGRAJ, June 5 -- The Permanent Lok Adalat, Prayagraj, on Wednesday took a serious note of the failure of sterilisation resulting in the birth of a child and directed the state government to provide Rs 2 lakh compensation to the mother for maintenance of the girl. The court also directed the state to provide Rs 5000 per month to meet the child's needs regarding school fee, food and proper upbringing till she completes her graduation or becomes 18, whichever is earlier. Permanent Lok Adalat chairman Viqar Ahmed Ansari, members Richa Pathak and Satyendra Mishra also directed to pay compensation of Rs 20,000 for failure of sterilisation and for mental and physical agony, which the applicant, Anita Devi, had to undergo since she conceived after the sterilisation operation. The complainant, a poor woman, who already had many children, opted for sterilisation. The operation was done on October 25, 2013. As she had complications, she got an ultrasound test done on January 31, 2014 and the report revealed that she was carrying a single live foetus of 16 weeks, six days. She later gave birth to the child. In her claim application against the chief medical officer, Allahabad (now Prayagraj), she sought Rs 5 lakh for the upbringing of the child, Rs 25,000 per month since the pregnancy till the birth of the child as well as Rs 20,000 for suffering mental and physical agony. The Permanent Lok Adalat observed, "...the doctor as also the state must be held responsible in damages of the sterilisation operation."...
