SC tells UP govt to review threat to Unnao rape survivor's family
New Delhi, Aug. 29 -- The Supreme Court on Thursday directed the Uttar Pradesh government to assess the threat perception of the 2017 Unnao rape case survivor's family where former BJP legislator Kuldeep Singh Sengar is the main accused, after the family said that soon after their security was withdrawn in March, miscreants attacked and ransacked their house.
Alleging that Sengar is a powerful man seeking vengeance after being convicted in the rape case in 2019 and later in a separate case involving the death of the victim's father in 2020, the application moved by the victim's mother sought recall of the March 25 order withdrawing CRPF security cover to all family members barring the victim.
The order of March 25 was passed on an application moved by the Union government.
Issuing notice on the application of the victim's mother, a bench of justices Pankaj Mithal and PB Varale said, "Conviction in a trial does not mean threat perception has vanished" and asked the state to respond to the plea within two week.
Advocate Ruchira Goel appearing for Uttar Pradesh government informed the court that the family has moved to Delhi and is not staying presently in the state and that given this, assessing threat preception may not be useful.
Additional solicitor general (ASG) Aishwarya Bhati appearing for the Centre informed the court that the March 25 order permits the family members to approach the local police station where they are residing if there is any threat to their lives.
The bench said, "Even if they are staying outside Uttar Pradesh, they need to be protected. Merely because conviction has taken place, it does not mean there is no threat perception..."
The victim, belonging to Dalit community, was a minor when she was raped by the accused including Sengar in 2017....
