SC slams SIT, orders probe into Noida officials' assets
New Delhi, Dec. 11 -- The Supreme Court on Wednesday directed the special investigation team (SIT) of the Uttar Pradesh Police, which is probing alleged excess payouts made by the Noida Authority as land compensation, to complete its investigation within two months. A bench headed by Chief Justice of India Surya Kant, sitting with justices Ujjay Bhuyan and N Kotiswar Singh, expressed dissatisfaction over the SIT's request for more time, remarking, "You also seem reluctant to conduct the probe."
Solicitor general Tushar Mehta, appearing for the Authority, submitted that most directions in the court's August 13 order had been complied with. On the allegation of collusion, Mehta argued that all compensation disbursed was strictly pursuant to court orders. The bench responded that it sought to ascertain whether officers had colluded to divert payments to ineligible individuals and whether such actions were carried out in concert with others.
Before constituting the SIT in August, the court had in January appointed a committee headed by then UP additional director general of police SB Shiradkar. The committee reported that excess compensation was paid in 1,198 cases although court-mandated payments only in 1,167 cases. It flagged 20 cases of excess disbursal and identified several officials as key suspects. The committee noted that establishing collusion would require detailed scrutiny of bank accounts and assets of officers and their family members.
Under the August order, the SIT was authorised to register cases once a preliminary inquiry indicated a cognizable offence. It was permitted to seek sanction to investigate officers under the Prevention of Corruption Act, with the state directed to decide such requests within two weeks....
