New Delhi, Sept. 27 -- The Supreme Court on Friday told the Madhya Pradesh government to arrest two policemen facing custodial death charge by October 7 or face contempt proceedings, observing that the state must uphold the majesty of the court which directed it in May to arrest the officials. Hearing a contempt petition against the state's additional chief secretary and the Central Bureau of Investigation filed by the victim's mother, the court directed the additional chief secretary and the investigating officer of CBI to be present in court on October 8 if the order is not complied with by then. A two-judge bench said, "If they were private persons, within 15 days they would be arrested. Because they are inspectors, you are finding it difficult to arrest them." The court's order came a day after it slammed the MP government for shielding the accused by not acting on its previous order for four months. It even questioned why the state failed to suspend the officers who have not reported to work since April. On Friday, additional advocate general for Madhya Pradesh Nachiketa Joshi informed the court that since May the two officers have not been paid and are currently under suspension. He added that their present location is not known. The court told Joshi, "Why don't you terminate both of them. You have reason to terminate. Once you do that, they will surface." The court even contemplated summoning the Director General of Police . "Your DGP will know the whereabouts of these two officers. Four months have passed. If this petitioner had not filed contempt, you would not have bothered about our order. Your submissions fail to impress us. But we are proceeding slowly and cautiously in this matter." The petitioner's lawyer advocate Payoshi Roy informed the court that the role of CBI in this case is equally suspect as it took more than a month after the court's May 15 order to visit the house of the accused officials.
