JODHPUR, May 21 -- The Rajasthan high court on Monday refused to quash the FIR registered under the NDPS Act against two individuals, including a constable and a complainant, who allegedly retained opium illegally for several days before reporting it, raising serious questions over the conduct of police personnel involved in a narcotics case, . Justice Farjand Ali, while dismissing the criminal miscellaneous petitions filed by petitioners Jai Singh and Balveer Singh, remarked on the highly irregular handling of the contraband and noted the suspicious role played by those entrusted with enforcing the law. The FIR, registered at Ratangarh police station in Churu district, involves offences under Sections 8/18, 29, and 59 of the Narcotic Drugs and Psychotropic Substances Act, 1985. "This is a very unique case of unlawful activities and exercise of power by the members of law enforcing authority and preventive team," the court observed. "Even a glance at the first information report manifests illegal retention of opium by the police constable since, as per the report, the alleged recovery was made on June 21, 2020 and it was reported to their own police station on June 25, 2020." Petitioner Balveer Singh, who filed the FIR, admitted to holding the opium for four days before handing it over. Jai Singh, another petitioner and a member of the team that intercepted the vehicle carrying the opium, is accused of playing a central role and is evading arrest.
