Justice Kant says same-day listing 'only if someone is being hanged'
New Delhi, Sept. 25 -- Supreme Court judge justice Surya Kant on Wednesday said he would not order same-day listing of a case unless "someone is about to be hanged," stressing the intense workload of judges and the toll it takes on their sleep and wellbeing.
Heading a bench with justices Ujjal Bhuyan and N Kotiswar Singh, justice Kant was dealing with requests for urgent listing of cases. Such mentioning is ordinarily taken up by Chief Justice of India (CJI) Bhushan R Gavai, the master of the roster, but since the CJI is currently presiding over a five-judge constitution bench, the responsibility fell on the second senior-most judge.
When senior advocate Shobha Gupta sought urgent listing of a case concerning the auction of a residential house in Rajasthan, justice Kant declined to entertain it on the same day.
"Unless someone is about to be hanged, I will never list a mentioned case on the same day. You people don't understand the plight of judges. Do you even know how many hours they work and how little sleep they get? Unless someone's liberty is at stake, we will not list it the same day," he said.
On being told that the auction notice had been issued a week earlier and some amount already deposited against the outstanding dues, justice Kant initially remarked that the matter could not be expected to be listed for the next couple of months.
However, he later directed the court master to place it for hearing on Friday. Justice Kant is in line to take over as the CJI in November this year....
