LUCKNOW, Dec. 21 -- More than three decades after a routine bus inspection uncovered ticketless travel, the Lucknow bench of the Allahabad high court on Friday upheld the dismissal of a Uttar Pradesh State Road Transport Corporation (UPSRTC) bus conductor removed from service in 2002 for collecting a total of Rs.285 in fare from 30 passengers without issuing tickets.
Justice Amitabh Kumar Rai dismissed the petition filed by Mohd Arif, who had questioned his removal from service after being found guilty of collecting fares without issuing tickets. The court said it found no illegality in the dismissal order or in the appellate authority's decision confirming it.
"Accordingly, this writ petition fails and is dismissed," the court said while rejecting the plea. The case relates to March 9, 1990, when an inspection team stopped a UPSRTC bus between Renukot and Robertsganj.
During a check, 30 of 83 passengers were found without tickets despite the conductor collecting Rs 285. Arif was chargesheeted, found guilty and dismissed in May 2002. His appeal failed. He later moved the high court citing procedural lapses, lack of witness examination, wrong authority and no action against the driver.htc...
