PRAYAGRAJ, Sept. 26 -- The Allahabad high court has stayed the arrest of a suspected Pakistani woman Shumaila Khan who has been teaching in a primary school in Bareilly since 2015. The order was passed by a division bench comprising Justice Siddhartha Varma and Justice Abdul Shahid on September 24 (Wednesday) on a writ petition filed by Shumaila Khan. The instant writ petition has been preferred for quashing the impugned FIR dated January 14, 2025 registered against her with allegation that she is citizen of Pakistan who is illegally residing in India. She is also employed as an assistant teacher in a primary school, Bareilly, on the basis of forged domicile certificate. Appearing on behalf of the petitioner, it was submitted by her counsel that against the cancellation of her domicile certificate, the petitioner has already preferred a writ petition wherein substantial hearing has already taken place. "We fix this case along with the connected case being Writ - C No. 5658 of 2025 (Ms. Shumaila Khan Alias Furqana vs. State of U.P. And three others) and since the issue before the court would be with regard to the citizenship of the petitioner, we provide that till the next date of listing the petitioner shall not be arrested," the court observed and directed to list this case on October 7....
